Welcome to the online auction platform operated by Bluegrass Auction Pros, Inc. (“Company,” “we,” “us,” or “our”). By accessing or using this website and registering to bid in any auction hosted by Bluegrass Auction Pros, Inc., you (“you,” “bidder,” “user,” or “participant”) agree to be legally bound by the following Terms & Conditions. Please read them carefully.

1. Eligibility

To register and participate in any auction:

You must be at least 18 years old.
You must provide accurate and complete information during the registration process.
You must have the legal capacity to enter into binding contracts.

We reserve the right to refuse registration or bidding privileges to any individual, at our sole discretion, with or without cause.

2. User Account

You are responsible for maintaining the confidentiality of your account login information.
You agree to be financially responsible for all bids placed through your account.
Unauthorized use of another person’s account is strictly prohibited.

3. Auction Terms

All auctions are subject to the specific Auction Terms & Conditions posted for each property or item. By bidding, you agree to those additional terms.
Auctions may be conducted with or without reserve as specified.
Buyer’s Premiums, deposits, payment terms, and other conditions will be clearly disclosed in the auction listing and apply to all bidders.

4. Bidding Responsibilities

Once a bid is placed, it cannot be retracted or canceled, except in circumstances authorized by Bluegrass Auction Pros, Inc.
Bids are legally binding offers to purchase.
You are responsible for monitoring the auction and ensuring your bids reflect your intent.

5. Website Usage

You agree to use this website only for lawful purposes.
You shall not engage in any conduct that interferes with the operation, integrity, or security of the website or auctions.
Any attempt to manipulate bidding, disrupt auctions, or harm other users will result in immediate termination of your account and potential legal action.

6. Disclaimers

All information provided on this website is believed to be accurate but is not guaranteed.
All properties and items are sold “AS IS, WHERE IS” with no warranties expressed or implied unless otherwise stated in writing.
We are not responsible for technical issues, internet outages, or errors that may affect your ability to place bids.

7. Limitation of Liability

Bluegrass Auction Pros, Inc. and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of this website or participation in any auction.

8. Modification & Termination

We reserve the right to modify these Terms & Conditions at any time. Continued use of the website constitutes your acceptance of any changes.
We may suspend or terminate your access to the website or bidding privileges for violation of these Terms or other improper conduct.

9. Governing Law

These Terms & Conditions are governed by the laws of the Commonwealth of Kentucky. Any disputes arising from your use of this website or participation in auctions shall be resolved exclusively in the appropriate courts located in Hardin County, Kentucky.

10. Winning Bidder Responsibilities for Real Estate Auctions

If you are the winning bidder on a real estate auction conducted by Bluegrass Auction Pros, Inc., you agree to sign the Auction Purchase Agreement provided by the Company within 24 hours of the conclusion of the auction. Failure to execute the Auction Purchase Agreement within this timeframe may result in forfeiture of your winning bid, disqualification from future auctions, and other remedies available to the Seller and Bluegrass Auction Pros, Inc. The Auction Purchase Agreement is a binding legal contract and is not contingent upon financing, inspections, or other conditions unless specifically stated in the auction terms for that property.

11. Down Payment Requirement for Real Estate Auctions

If you are the winning bidder on a real estate auction conducted by Bluegrass Auction Pros, Inc., you are required to pay a non-refundable down payment of 10% of the final purchase price or $10,000, whichever is greater, no later than 72 hours following the conclusion of the auction. This down payment must be delivered to Bluegrass Auction Pros, Inc. or its designated escrow account within the stated timeframe. Time is of the essence with respect to this requirement. Failure to provide the down payment within 72 hours may result in forfeiture of your winning bid, disqualification from future auctions, and other legal remedies available to the Seller and Bluegrass Auction Pros, Inc.

12. Credit Card Requirement for Registration

In order to register for an auction conducted by Bluegrass Auction Pros, Inc., all bidders are required to provide valid credit card information during the registration process. This requirement is in place to verify the identity of bidders, deter fraudulent activity, and help ensure that only serious, qualified individuals participate in our auctions.

Your credit card may be pre-authorized for a nominal amount (typically $1) to confirm its validity, though this is not an actual charge and will automatically be released in accordance with your bank's policies.

In some auctions, your credit card may also be charged for applicable deposits, buyer’s premiums, or other fees, as outlined in the specific Auction Terms & Conditions for each property or item.

By providing your credit card information, you authorize Bluegrass Auction Pros, Inc. to process such charges in accordance with these Terms & Conditions and any additional auction-specific terms. Failure to provide valid credit card information will result in your registration being denied.

13. Acceptance

By registering to bid on this site, you acknowledge that you have read, understand, and agree to these Website Terms & Conditions, along with any additional terms posted for specific auctions.
